In Maandblad voor Ondernemingsrecht (Magazine for Corporate Law) Marieke Faber discusses the judgment of the Court of the Appeal in the case of Milieudefensie c.s. against Shell. The Court of Appeal confirmed that corporations, and especially corporations such as Shell, have a legal duty to reduce CO₂ emissions in line with the Paris Agreement. The court, however, did not order Shell to reduce its emissions by 2030 with a specific amount. Marieke discusses the court’s reasoning and its implications for the corporate sector.
